These Terms of Use ("Terms") are an agreement between you and DMVKids ("DMVKids", "we", "us") covering the DMVKids app and the website at dmvkids.app (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
The short version: DMVKids is a free directory that gathers event listings published by other organizations. We do not run, sponsor, staff, inspect or endorse any event or venue you find here. Details change and listings can be wrong — always confirm with the organizer before you go, and use your own judgement about whether an event is safe and suitable for your child.
DMVKids is an aggregator. We collect publicly posted listings from county parks and recreation departments, public libraries, museums, fairs, tourism boards, venues and similar sources, and present them in one place. We also list "Adventures" — parks, playgrounds, play spaces and similar destinations operated by third parties.
We are not the organizer, host, sponsor, operator, owner or promoter of any event, venue, activity or destination listed in the Service. We have no relationship with those organizations beyond reading what they publish. We do not:
Any contract you enter into — buying a ticket, registering for a program, entering a venue — is solely between you and that organizer or venue. Any dispute about an event belongs with them, not with us.
Listings are collected by automated software, summarized and categorized with automated tools including artificial intelligence, and refreshed periodically. They can be incomplete, out of date, mis-categorized or simply wrong. Events are cancelled, rescheduled, relocated, sold out or made ticket-only without telling us. Age ranges, prices, accessibility information and "free" labels are as published by the source, and may be inaccurate.
Every listing links to the organizer's own page, and that page — not DMVKids — is the authority. You agree to confirm details directly with the organizer before travelling to or relying on any event.
You are solely responsible for deciding whether any event, venue or activity is appropriate, safe and suitable for you and for any child in your care, and for supervising that child at all times. Nothing in the Service is a recommendation that any particular event is safe, suitable, or appropriate for any particular child.
You attend events and visit venues at your own risk. To the fullest extent permitted by law, you assume all risk of personal injury, illness, property damage, loss and other harm arising from attending, travelling to or from, or otherwise relying on anything you find through the Service.
"Near me" uses your device's location, with your permission, to show events within a radius of where you are. Location is optional — you can browse by county instead, and you can withdraw permission at any time in your device settings.
Location results are approximate. Distances, map pins and addresses are estimates derived from published addresses and automated geocoding, and can be wrong or point to the wrong place. The Service is not a navigation, emergency or safety tool. Do not rely on it for directions, for travel time, for locating a person, or in any situation where being in the wrong place could cause harm. Follow official signage and your own navigation app, and obey all traffic laws — never interact with the Service while driving.
Search understands everyday phrases, "Build My Day" assembles a suggested itinerary, and listings carry automatically generated summaries, categories and age ranges. These are produced by automated systems, including artificial intelligence, and are provided for convenience only. They can be inaccurate, incomplete or unsuitable. They are not advice of any kind, and you should not rely on them without checking the organizer's own information.
If you turn them on, we send a reminder the day before an event you saved, and a weekly roundup. Delivery depends on Apple, Google, your network and your device settings, and is not guaranteed. Notifications can be delayed, duplicated or never arrive. Do not rely on them as your only reminder for anything that matters. You can turn them off at any time from the account menu or in your device settings.
Most of the Service works without an account. If you create one — using Google or Apple sign-in, handled by our authentication provider — you must be 18 or older, provide accurate information, and keep access to your account secure. You are responsible for activity under your account. You can delete your account at any time from the account menu in the app, which permanently deletes your account, your saved events and your notification settings. We may suspend or terminate accounts that violate these Terms.
You agree not to:
Event information belongs to the organizations that published it and remains theirs. The DMVKids name, design, original text and compilation are ours. We list events on the understanding that public event listings are published to be shared, and every listing credits and links to its source.
If you are an organizer or rights holder and want a listing corrected or removed, email dmvkidsevents@gmail.com with the listing and what is wrong. We will review and act on reasonable requests promptly, and will remove a listing on request from the organization that published it. Copyright complaints may be sent to the same address.
The Service links to organizer websites, ticketing sites, maps and other third-party services, and relies on third-party providers for hosting, authentication, notifications and automated processing. We do not control those services, are not responsible for them, and their terms and privacy policies apply when you use them.
The Service is free and provided on an as-available basis. We may change, suspend, limit or discontinue any part of it, including any listing or feature, at any time and without notice, and we are not liable for doing so. We do not promise any level of availability, and coverage areas and sources may change.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THAT, WE MAKE NO WARRANTY THAT LISTINGS ARE ACCURATE, CURRENT, COMPLETE OR RELIABLE; THAT ANY EVENT WILL TAKE PLACE AS DESCRIBED, OR AT ALL; THAT ANY EVENT, VENUE OR ORGANIZER IS SAFE, LAWFUL, INSURED, SUITABLE FOR CHILDREN, OR AS REPRESENTED; OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, DMVKIDS AND ITS OWNER, OPERATORS, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY.
WE WILL ALSO NOT BE LIABLE FOR ANY INJURY, DEATH, ILLNESS, PROPERTY DAMAGE, LOSS OR OTHER HARM ARISING FROM ANY EVENT, VENUE, ACTIVITY, ORGANIZER OR THIRD PARTY YOU FIND THROUGH THE SERVICE, OR FROM ANY LISTING BEING INACCURATE, INCOMPLETE, CANCELLED OR CHANGED.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE — WHICH FOR A FREE SERVICE IS ZERO — OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless DMVKids and its owner from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms or of any law, or your attendance at or interaction with any event, venue or organizer found through the Service — except to the extent caused by our own gross negligence or wilful misconduct.
The Service is intended for parents, guardians and other adults. It is not directed to children under 13, and we do not knowingly collect personal information from them. Accounts require you to be 18 or older. If you believe a child has provided us personal information, email us and we will delete it.
If something goes wrong, please email us first at dmvkidsevents@gmail.com — nearly everything can be sorted out informally, and you agree to try for 30 days before starting formal proceedings.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. You and we agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in Maryland, and we each consent to their jurisdiction. Either of us may bring an individual claim in small claims court instead. To the extent permitted by law, claims must be brought individually and not as part of a class or representative action.
You obtained the app through the Apple App Store or Google Play. Those companies are not parties to these Terms and are not responsible for the Service, its content, or any claim relating to it. They have no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and are not on any U.S. Government restricted-parties list.
We may update these Terms. The date at the top shows the most recent version, and material changes will be noted in the app. Continuing to use the Service after a change means you accept the updated Terms.
If any provision of these Terms is held unenforceable, the rest remain in force and that provision will be applied as closely as possible to its original intent. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours, including to a company formed to operate DMVKids or in connection with a sale of the business. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
